Terms & Conditions – Labour Market Testing Services

1. Scope of Services

Job Source provides professional Labour Market Testing (“LMT”) preparation services, including advertisement drafting, placement, monitoring, applicant registers, and preparation of LMT compliance reports suitable for submission to the Department of Home Affairs (“DHA”).

2. Client Responsibilities

  • Clients are responsible for supplying accurate, complete, and lawful information (including draft text, salary details, and position descriptions).

  • Clients must review and approve draft advertisements and LMT reports prior to publication or submission.

  • Job Source will not publish or finalise any document without written approval from the client.

3. Quality Assurance

Job Source exercises reasonable care, skill, and diligence in delivering its services. Internal QA steps include customised templates, systemised checklists, and mandatory client approvals prior to publication.

4. Liability

  • Job Source will not be liable for any loss, damage, delay, or refusal arising from:

    • Errors, omissions, or inaccuracies in information or text provided by the client.

    • Delays in client approvals, responses, or provision of required information.

    • Changes in DHA policy or interpretation beyond Job Source’s reasonable control.

  • Where an error attributable solely to Job Source is identified, we will rectify it promptly and, where necessary, re-run the LMT process at no additional cost.

5. Indemnity

Clients agree to indemnify and hold harmless Job Source, its directors, employees, and contractors against any claim, cost, liability, or expense (including legal fees) arising from:

  • Use of inaccurate, incomplete, or misleading information provided by the client.

  • Client-requested amendments (including verbatim use of supplied text) which later prove non-compliant.

  • Third-party claims relating to the content of advertisements approved by the client.

6. Refunds and Credits

  • No refunds are offered once advertising has commenced, except where a proven error is attributable solely to Job Source.

  • In such cases, Job Source may, at its discretion, re-run advertisements at its own cost or provide a credit towards future services.

7. Record-Keeping

Job Source retains all work product files and supporting documents, including screenshots (showing proof of publication), evaluation notes, and submitted résumés. Screenshots capture the relevant publication dates, and all files preserve their original metadata, including creation and capture timestamps. These records are consolidated into an LMT report pack and can be readily provided to clients to support DHA audit or compliance requirements.

8. Limitation of Liability

To the fullest extent permitted by law, Job Source’s total liability for any claim arising from its services will not exceed the total fees paid by the client for that specific LMT service.

9. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria..
